CraftAmplify Terms of Use

Please read these Terms of Use ("Terms") carefully before accessing or using the CraftAmplify website (craftamplify.com) and enrolling in any courses or services offered by CraftAmplify LLC ("CraftAmplify," "we," "us," or "our"). By accessing or using our website and services, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree to all the Terms, you may not access the website or use any services.

1. Acceptance of Terms

By accessing and using the CraftAmplify website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. These Terms constitute a legally binding agreement between you and CraftAmplify LLC.

2. Eligibility

Our courses and services are intended for individuals who are at least 14 years of age or older. By using our services, you represent and warrant that you meet this age requirement.

CraftAmplify currently operates and offers services exclusively within the United States. By accessing or using our services, you confirm that you are located within the United States. We do not currently offer services to individuals residing outside of the United States.

3. Course Enrollment and Payment

Course Fees: All fees for courses are clearly stated on the respective course pages. You agree to pay all applicable fees and taxes associated with your enrollment.

Payment Processing: We use third-party payment processors (e.g., Stripe) to handle all transactions. Your payment information is subject to the terms and privacy policies of these third-party processors. CraftAmplify LLC does not store your full payment card details.

Refund Policy: All course sales are final once the course session begins. Refunds will only be considered if a cancellation request is received in writing to [email protected] at least 48 hours prior to the scheduled start date of the first class session you enrolled in. No refunds will be issued for cancellations made less than 48 hours before the start date, or after the course has commenced.

Course Access: Upon successful enrollment and payment, you will receive access to the live course sessions and supplementary materials for a period of one (1) year from your enrollment date. Access to materials is provided "as-is" and is not guaranteed indefinitely. CraftAmplify LLC reserves the right to modify, update, or discontinue course materials or access at any time, for any reason, without prior notice.

4. Intellectual Property Rights

CraftAmplify Content: All content provided through the CraftAmplify website and courses, including but not limited to text, graphics, logos, images, audio clips, video clips, digital downloads, data compilations, course materials, slides, code examples, and software, is the exclusive property of CraftAmplify LLC or its content suppliers and is protected by United States and international copyright laws.

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the course materials solely for your personal, non-commercial educational purposes. This license does not permit you to:

  • Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the course materials without our prior written consent.
  • Use the course materials for any commercial purpose, including but not limited to teaching, training, or consulting services.
  • Copy, share, or redistribute any part of the course content to third parties.
  • Remove or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this site or the course.

User-Generated Content (UGC): By participating in our courses, sharing your screen, creating public GitHub repositories related to course work, or posting content on any CraftAmplify-affiliated platforms (e.g., future Slack or Discord channels), you grant CraftAmplify a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content (in whole or in part) for the purpose of operating, promoting, and improving our services, including but not limited to using code examples as teaching materials, sharing anonymized project examples, or telling stories from past classes without naming individuals. We will always seek explicit permission before using any identifiable content (e.g., your name, image, or specific voice recording) for promotional purposes outside of the immediate class context.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Unauthorized Access: Attempting to gain unauthorized access to any part of the website, course materials, or related systems or networks.
  • Misuse of Materials: Copying, distributing, modifying, or creating derivative works from CraftAmplify's course materials or intellectual property for any purpose other than your personal, non-commercial education. This explicitly includes using the materials to teach or develop similar courses or training programs.
  • Disruptive Behavior: Engaging in any conduct that disrupts or interferes with the normal operation of the website, live class sessions, or community platforms, or that is abusive, harassing, or disrespectful to instructors, CraftAmplify personnel, or other participants.
  • Malicious Acts: Intentionally attempting to harm, disrupt, or gain unauthorized access to the mock enterprise environment, our website, or any related systems.
  • Misrepresentation: Providing false, inaccurate, or misleading information during registration or in any communication with CraftAmplify.
  • Unlawful Use: Using the services for any unlawful purpose or in violation of any applicable local, state, national, or international law.
  • Sharing Access: Sharing your course access credentials or materials with any third party.
  • Commercial Use: Using the services or materials for any commercial purpose without our express written consent.
  • Disparagement: Engaging in any activity that disparages, defames, or harms the reputation of CraftAmplify or its instructors.

6. Termination

We reserve the right to terminate or suspend your access to all or part of the services, at our sole discretion, at any time, without notice or liability, for any reason, including but not limited to:

  • Any breach of these Terms.
  • Engagement in any prohibited activities.
  • Conduct that we deem harmful or disruptive to CraftAmplify, its instructors, or other users.
  • If we discontinue the course or service.

In the event of termination due to your breach of these Terms, no refunds will be issued.

7. Disclaimers and Limitation of Liability

Educational Purpose: CraftAmplify provides educational content on using emerging technologies. While we aim to provide a comprehensive and practical learning experience, this course is for informational and educational purposes only.

No Guarantees: We make no guarantees regarding the specific outcomes, results, or employment opportunities you may achieve by applying the skills learned. You are solely responsible for exercising your own judgment and discretion when applying these concepts in your professional or personal work.

"As-Is" Service: The website and services are provided on an "as-is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Service Availability: We do not guarantee that the website or services will be uninterrupted, secure, or error-free. The service may be unavailable due to maintenance, technical issues, or other unforeseen circumstances. CraftAmplify LLC shall not be liable for any downtime or unavailability of the service.

Limitation of Liability: To the fullest extent permitted by law, in no event shall CraftAmplify LLC, its instructors, affiliates, agents, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Code Responsibility: With great power, comes great responsibility. CraftAmplify LLC and its instructors are not liable for any issues, damages, or liabilities that may arise from your application of skills learned in the course in any professional or personal setting.

8. Indemnification

You agree to defend, indemnify, and hold harmless CraftAmplify LLC, its instructors, affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the services, including, but not limited to, your User-Generated Content, any use of the website's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the website.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New York, New York. The decision of the arbitrator shall be final and binding upon the parties, and judgment may be entered thereon in any court having jurisdiction thereof. You agree that any arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will notify you of any changes by updating the "Last Updated" date at the top of these Terms and by posting the updated Terms on our website. Your continued use of the website or services after any such changes constitutes your acceptance of the new Terms.

11. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and CraftAmplify LLC regarding the services.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions of these Terms will remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and CraftAmplify LLC's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
